Terms of use

For this website, the open-source software, the WordPress plugin and Tacilytics Cloud.

1. Provider

Fabian Budde, Am Eickhagen 9, 59909 Bestwig, Germany (see imprint). Email: hello@tacilytics.com

2. What these terms cover

These terms apply to the use of tacilytics.com, the Tacilytics server software published on GitHub and npm, and the WordPress plugin “Tacilytics – Privacy-Friendly Analytics” (source code). Section 8 applies in addition to Tacilytics Cloud, our hosted service.

3. Open-source licences

The server software is licensed under the MIT licence, the WordPress plugin under the GNU General Public License version 2 or later. The licence texts in the repositories apply to the software and take precedence over these terms where they differ. Both are free of charge.

4. Self-hosting: your server, your data

When you run Tacilytics yourself or connect the WordPress plugin to your own server, the data never reaches us. You are the controller under the GDPR for the data collected on your website, and you are responsible for operating the server, keeping it updated, and for informing your visitors in your own privacy notice. The plugin only contacts the server address you enter; it does not contact tacilytics.com or any other server run by us.

5. No warranty

The software is provided free of charge and “as is”, as stated in its licence. We cannot guarantee that it is free of errors, fits a particular purpose or is suitable for your legal situation. Statements on this website about cookies and consent describe how the software works; they are not legal advice.

6. Liability

Because the software is a gift (§§ 521, 524 BGB), we are liable only for intent and gross negligence, and for fraudulently concealed defects. Liability for injury to life, body or health and under the German Product Liability Act remains unaffected.

7. Use of this website

You may read, link to and quote this website. Do not use it to attack or overload our systems, and do not use the contact form for unsolicited advertising.

8. Tacilytics Cloud

8.1 Service. Tacilytics Cloud is the Tacilytics software, run by us on servers of Hetzner Online GmbH in Germany. You get an account with a dashboard for your websites, the tracking script and the API. We do not promise an availability figure; we carry out maintenance and updates so that disruptions stay short, and we announce planned interruptions where we can.

8.2 Who can sign up. The Cloud is meant for businesses, freelancers and website operators who use it for their own websites. You must be at least 18 years old and give a working email address. One account per person or business; you may add several websites to it.

8.3 Trial. New accounts get 90 days free. To continue after the trial you choose a plan and add a payment method in the checkout; nothing is charged before the trial ends. If there is no plan when the trial ends, tracking is paused (see 8.6).

8.4 Prices and payment. €1.99 per website and month, or €9.99 per website and year, for up to 50,000 page views per website and month. Payments are processed by Stripe as reseller and merchant of record (Stripe Managed Payments): you buy the subscription from Stripe, which also handles sales tax and VAT, invoices and payment questions under its own terms shown in the checkout. Prices shown include the tax that applies to you, as calculated in the checkout. Subscriptions renew automatically for the chosen period until you cancel.

8.5 Fair use. If a website has more than 50,000 page views in a month, we let you know by email. We do not cut off counting; we will offer a plan that fits your traffic, and only charge more after you agree. Do not use the Cloud to track people without the legal basis your law requires, for anything unlawful, or in a way that endangers our systems (for example load testing or sending forged data on purpose).

8.6 Cancellation, pause and deletion. You can cancel at any time in the billing portal; the subscription then runs until the end of the period you paid for. When there is no active plan, tracking pauses: nothing new is recorded, and you can still sign in and export your data as CSV. Thirty days after the pause, we delete the account and all statistics; we warn you by email three days before. You can delete your account yourself at any time in the dashboard; this ends the subscription immediately and deletes everything at once. Accounts whose email address was never confirmed and that have no plan are deleted after seven days.

8.7 Your data and processing on your behalf. For the statistics of your websites you are the controller, and we process them on your behalf. The data processing agreement is part of these terms and applies automatically when you sign up. You can export your data at any time.

8.8 Changes. If we change these terms or prices for the Cloud, we tell you by email at least six weeks in advance. Price changes apply from your next billing period. If you do not agree, you can cancel before the change takes effect.

8.9 Liability for the Cloud. For the paid service we are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for the breach of essential obligations (obligations whose fulfilment makes the service possible and on which you may rely), limited to the damage typical and foreseeable for this kind of contract, and per year at most to the amount you paid us in the twelve months before the damage. Section 6 applies to the free software only.

8.10 Withdrawal for consumers. The contract for the subscription is concluded with Stripe as merchant of record; the information on the right of withdrawal is given in the checkout. If you are a consumer and use the Cloud during a withdrawal period, you agree that the service starts at once.

9. Changes and governing law

We may update these terms when the software or this website changes; the version published here applies. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection rules of your country of residence remain unaffected.
